Please read these Asset Terms of Use Carefully.

These Asset Terms of Use describe rules for visitors who visit this Monteris web site and who wish to download specific media including but not limited to images, videos, animations, brochures, presentations, instructions and other downloadable materials (“Assets”). These Asset Terms of Use hereby incorporate the Terms of Use and Privacy Statement for the Monteris.com web site, of which this download service is a part. We may change these Asset Terms of Use at any time. By accessing assets on this page, you indicate that you accept the most recent version of these Asset Terms of Use.

License to Use. You are hereby granted a non-exclusive, limited, and revocable license to use the Assets in accordance with these Asset Terms of Use. Monteris reserves the right to revoke this license generally, or your right to use specific Assets, at any time. If Monteris revokes this license, you agree immediately to cease your use of all Assets, including removal of Assets from your web site, if any.

Restrictions on Use. You agree not to: (a) display or use an Asset in a manner that, to a reasonable person, may be considered to promote the use of Monteris’ products or therapies for uses that are not approved or cleared by the Food and Drug Administration (See Indications, Safety & Warnings on this web site) ; (b) display or use an Asset on any web page or media that discusses, depicts, refers to or promotes any unapproved or uncleared use of Monteris products or therapies; (c) modify an Asset, other than making to-scale adjustments in size, without the express prior written consent of Monteris (for example, by removing any disclosure or copyright or trademark notice or otherwise altering the content, appearance or function of the Asset); (d) display or use an Asset in a manner that, to a reasonable person, may be deemed obscene, defamatory, harassing, grossly offensive, or malicious; (e) display or use an Asset in a manner inconsistent with any applicable instructions provided on this web site; (f) sublicense the Assets to any third party or otherwise provide the Assets for a third party’s commercial use; (g) display our trademark or logo on any web page or other media without our separate express prior written permission, except incidentally as part of an Asset that is otherwise used in accordance with these Asset Terms of Use; or (h) link to any page on the Monteris.com web site other than the Monteris.com home page, unless you and we have entered into a separate written agreement allowing such a link.

Changes in Asset Use. You agree that you will, promptly upon receipt of any written request from Monteris, either make such changes in your use of an Asset as Monteris may request (for example, by updating the Asset on your web site) or, alternatively, terminate your use of such Asset. You agree to notify Monteris promptly in the event that your email address changes from that provided to Monteris for the purpose of access to the Assets.
Revocation of Permission to Use. If you use the Assets in a way that is not clearly allowed by these Asset Terms of Use, you are violating your agreement with us and may be violating copyright, trademark, and other laws. In that case, we automatically revoke your permission to use this web site and the Assets. Title to the Assets remains with us or with the authors of the materials contained on this web site. All rights not expressly granted are reserved.

Miscellaneous. If any provision of these Asset Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Asset Terms of Use, which shall remain in full force and effect. No waiver of any of these Asset Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. If you violate these Asset Terms of Use in a way that causes harm to others, you agree to hold Monteris harmless against any liability for that harm. These Asset Terms of Use are governed by the internal substantive laws of the State of Minnesota, without respect to its conflict of laws principles, and the federal laws of the United States.
